محامي يكشف ل 360 الحالات التي يتم فيها إسقاط ولاية الأب و منحها للأم
خلقت قضية إسقاط الولاية الشرعية، التي رفعتها الفنانة جميلة الهوني ضد طليقها الممثل أمين الناجي، جدلا كبيرا عبر مواقع التواصل الاجتماعي، حيث عبر معظم النشطاء عن تعاطفهم مع هذه الأم، التي كشفت في تصريحات صحفية أن طليقها يمتنع عن الوفاء بالتزاماته تجاه ابنه، سواء المادية أو الاجتماعية، حيث لا يبادر إلى رؤيته، ولا يرسل نفقته، لكنه يتدخل في كل مسارات حياته.
أضافت الفنانة أن «الناجي منع ابنه أيضا من الولوج إلى مدارس البعثات الأجنبية، إلى جانب منعه من السفر إلى برشلونة لمدة 3 أيام لزيارة ملعب فريقه المفضل وخوض تداريب رياضية هناك».
وفتحت هذه القضية عدة تساؤلات لدى بعض الأمهات، اللواتي كن لا يعرفن ما معني الولاية الشرعية، وما لهن وما عليهن بعد الطلاق، خاصة أن البعض لازال غير مضطلع بما يكفي على قوانين مدونة الأسرة. ولتوضيح كل هذه الأمور، أجرى LE360 لقاء مع سعد السهلي، المحامي بهيئة الرباط، الذي رد على هذه التساؤلات، موضحا أن «الولاية هي منح سلطة قانونية إلى شخص وصي على الطفل الذي لم يبلغ بعد سن الرشد القانوني ليصبح الوالي على نفسه».
وتابع: «الولاية لا تتعلق بجنسية الشخص، وإنما بديانته، لأن مدونة الأسرة تعتمد في الأصل على الشريعة الإسلامية. وفي المغرب، تمنح الولاية للأب، إلى حين سقوط الفرض شرعا، أي أن يصبح الطفل له حق الاختيار عند بلوغه سن 16 عاما، أو عند بلوغه سن الرشد القانوني، وتصبح لديه كامل المسؤولية على تصرفاته».
وكشف السهلي أن هناك حالات استثنائية يتم فيها اسقاط ولاية الأب وهي حسب المادتين 236 و238 من مدونة الأسرة: «فقدان الأب للأهلية، أو غيابه لمدة طويلة، أو وفاته، وفي هذه الحالات تنتقل الولاية إلى الأم».
وأوضح هذا المحامي أن الولاية القانونية لا علاقة لها بالحضانة، وتابع: «الولاية هي جانب قانوني وتدبيري، تعطى حسب التشريع المغربي للأب، ولكن ليس بشكل مطلق، لأن القانون المغربي دائما يراعي المصلحة الفضلى للطفل».
وعن الحالات المشابهة لحالة الفنانة جميلة الهوني، أي الحالات التي يمارس فيها الأب تعسفا في استعمال الولاية الشرعية، كشف سعد السهلي، أن وزير العدل، عبد اللطيف وهبي، قد صرح أنه «سيتم إجراء تعديلات في تشريع مدونة الأسرة تمس استغلال بعض الآباء للولاية الشرعية».
وأضاف: «ورغم وجود فراغ تشريعي حالي في هذا الجانب، فأعتقد أن القضاء، طبقا لمبدأ المصلحة الفضلى للطفل، سيعطي حق الولاية للأم».
